Body Abroad operates strictly and irrevocably as a non-medical intermediary and administrative facilitator, solely enabling informational connections, logistical coordination, and communication relays between Clients and independent third-party clinics, hospitals, healthcare providers, or aesthetic facilities (“Clinics” or “Service Providers”) for purely non-clinical, preparatory, and organizational purposes. Under no circumstances do we provide, render, endorse, recommend, participate in, oversee, or assume any responsibility for any medical, diagnostic, therapeutic, clinical, surgical, rehabilitative, or health-related activities, including but not limited to consultations, evaluations, treatments, procedures, aftercare, or outcomes. Body Abroad categorically and irrevocably disclaims any role, capacity, or involvement as a healthcare provider, medical professional, diagnostic entity, therapeutic advisor, or clinical operator. We do not, under any circumstances, diagnose conditions, prescribe treatments, perform evaluations, render medical opinions, or engage in any activities regulated under medical, pharmaceutical, or health laws in any jurisdiction. All such functions are the exclusive province of the Clinics, with whom you must independently contract directly.1.4. In facilitating introductions, communications, or logistical arrangements, Body Abroad makes no representations or warranties regarding the accuracy, completeness, timeliness, reliability, or confidentiality of any information exchanged. We may, in our absolute discretion, offer ancillary support such as scheduling relays or travel referrals, but such support is gratuitous, non-binding, and revocable at any time without notice or liability.1.5. For absolute clarity and to preclude any misinterpretation, Body Abroad is not, and shall not be construed as, a travel agency, tour operator, package travel provider, transportation carrier, accommodation broker, or similar entity under Directive (EU) 2015/2302, the Austrian Package Travel Act (PRG), or analogous legislation worldwide. Any travel, lodging, or ancillary components are mere referrals to independent third-party providers, with all contracts, risks, and liabilities forming directly between you and such providers.1.6. These Terms apply comprehensively to all inquiries, discussions, or facilitations involving aesthetic and beauty matters, including but not limited to hair transplants, dermal fillers, laser treatments, body sculpting, or wellness adjuncts, but strictly limited to non-clinical coordination. Any procedural references on the Platform are aggregated from external sources for informational illustration only, without any endorsement, verification, or guarantee of applicability, safety, or results.1.7. Body Abroad reserves the right to refuse, suspend, or terminate Services to any User at any time, for any reason or no reason, including but not limited to suspected violations, risk assessments, or operational discretion, without prior notice, liability, or obligation to provide explanations. For Consumers, such actions shall comply with applicable consumer protection laws.2. Eligibility, User Representations, Warranties, and Obligations2.1. Access to and use of the Services is strictly conditioned upon your being at least eighteen (18) years of age (or the legal age of majority in your jurisdiction, if higher) and possessing full legal competence to form binding contracts. Minors, legally incapacitated individuals, or those under guardianship are prohibited from using the Services unless represented by a verified legal guardian who assumes all liabilities, risks, and indemnities hereunder. Body Abroad may require proof of eligibility at any time and deny Services if unsatisfied.2.2. You covenant, represent, and warrant that all information you provide to Body Abroad or any Clinic (including but not limited to personal identifiers, medical history summaries for coordination, preferences, financial details, and travel plans) is accurate, complete, current, verifiable, and not misleading in any respect. Any inaccuracies, omissions, fabrications, or updates not promptly communicated shall immediately absolve Body Abroad of all responsibility for any resulting delays, errors, miscommunications, damages, or Claims, and may result in immediate termination of Services.2.3. You assume sole, absolute, and non-delegable responsibility for obtaining, maintaining, and complying with all necessary travel documentation, including but not limited to passports, visas, entry permits, vaccination records, health certificates, COVID-19 or similar declarations, customs requirements, and public health protocols of both your origin and destination jurisdictions. Body Abroad may offer general, non-binding guidance on such matters but disclaims all warranties as to its accuracy, completeness, or applicability; reliance thereon is at your exclusive risk.2.4. Prior to pursuing any Clinic referral or engagement, you must independently obtain comprehensive, professional medical advice from a licensed healthcare practitioner in your home jurisdiction to evaluate the appropriateness, risks, benefits, and alternatives of any international aesthetic procedure, including potential complications associated with transplants, enhancements, or travel. Body Abroad neither recommends, endorses, nor assumes liability for any treatments, and you acknowledge that all decisions are yours alone.2.5. You expressly acknowledge, understand, and accept the inherent, unavoidable, and multifaceted risks of medical tourism and aesthetic procedures, including but not limited to regulatory variances across jurisdictions, language and cultural barriers, differing medical standards, postoperative complications (e.g., infections, rejections, scarring, dissatisfactory results), unforeseen health outcomes, travel disruptions, financial losses, and legal recourse limitations in foreign venues. Body Abroad provides no assurances, guarantees, or indemnities regarding the fulfillment of your expectations, aesthetic outcomes, recovery processes, or any other aspect of your experience.2.6. You are solely obligated to procure, maintain, and evidence (upon request) comprehensive insurance coverage tailored to medical tourism risks, including but not limited to travel cancellation/interruption, medical evacuation/repatriation, emergency medical treatment, liability for third-party Claims, coverage for procedure complications (e.g., revisions, infections, aesthetic dissatisfaction), and loss of belongings or opportunities. Failure to maintain such insurance shall not impose any duty on Body Abroad, and you waive any Claims arising from uninsured or underinsured events.2.7. You agree to comply with all applicable laws, regulations, and standards, including but not limited to anti-bribery (e.g., FCPA, UK Bribery Act), export controls, sanctions (e.g., OFAC), data protection, and healthcare privacy laws. You represent that you are not a sanctioned individual or entity and will not use the Services for prohibited purposes. Any non-compliance shall entitle Body Abroad to immediate termination and reporting to authorities, with you indemnifying us for all resultant Claims.2.8. You warrant that your use of the Services will not infringe any third-party rights, including Intellectual Property, privacy, or contractual obligations. You shall not use the Services for any unlawful, fraudulent, abusive, or competitive purposes, including but not limited to reverse engineering, data mining, or soliciting Clinics independently to circumvent our facilitation.2.9. Prohibited Conduct includes, without limitation: (a) submitting false or misleading information; (b) impersonating others; (c) harassing or threatening staff or Clinics; (d) using automated tools (e.g., bots, scrapers) to access the Platform; (e) transmitting viruses or harmful code; (f) overloading systems; (g) circumventing security measures; (h) commercial exploitation without consent; or (i) any act that, in our sole judgment, poses risks to the Platform or others. Violations may result in account suspension, legal action, and forfeiture of rights. For Consumers, prohibitions are interpreted in line with fair contract terms under EU law.3. Nature and Extent of the Services3.1. The Services are exhaustively and restrictively limited to the following non-medical, administrative functions: (a) Aggregating and presenting potential Clinic options based on your provided criteria (e.g., location, budget, procedure category such as hair transplants), drawing from publicly available data or Clinic submissions, without any vetting or endorsement; (b) Relaying non-clinical communications between you and Clinics, acting as a passive conduit without editing, verifying, or assuming responsibility for content; (c) Providing optional logistical aids, such as appointment timing suggestions, travel itinerary outlines, or referral links to third-party vendors, all on a non-binding basis; (d) Disseminating general, non-personalized informational resources on aesthetic tourism trends, destination summaries, and indicative pricing ranges as reported by Clinics, subject to change without notice. 3.2. The Services are purely facilitative, clerical, and devoid of any clinical, medical, or advisory elements. Body Abroad does not conduct assessments, determinations, or interventions of any kind; all preliminary or substantive discussions with Clinics are under their exclusive control and liability.3.3. Any statistical, numerical, or descriptive data presented (e.g., satisfaction rates like 92%, client volumes like 350K+, or consultation figures like 55K+) is historical, aggregated from Clinic or public sources, and provided for illustrative purposes only. Such data carries no predictive value, warranty, or guarantee; you must independently validate all metrics directly with the Clinic, and Body Abroad disclaims all liability for reliance thereon.3.4. In extraordinary or unforeseen circumstances, including but not limited to global health emergencies (e.g., pandemics), geopolitical conflicts, economic downturns, regulatory shifts, or technological failures, Body Abroad reserves the right to suspend, modify, or discontinue Services (in whole or part) without prior notice, liability, or compensation, provided we make commercially reasonable efforts to notify affected Users where feasible.3.5. Body Abroad undertakes no due diligence, audits, inspections, or ongoing monitoring of Clinics beyond cursory review of publicly accessible information (e.g., JCI or ISO certifications). We make no representations regarding a Clinic's licensure, accreditation status, financial solvency, operational reliability, ethical practices, or compliance with laws; all such verifications are your sole responsibility.3.6. For aesthetic-specific facilitations, including transplants or enhancements, Body Abroad may offer broad category overviews but explicitly refrains from discussing clinical details, risks, benefits, contraindications, or alternatives, deferring entirely to Clinic professionals. Any User attempt to solicit medical advice through the Services shall be deemed a material breach.3.7. Body Abroad may, at its discretion, integrate third-party tools, APIs, or links (e.g., payment gateways, mapping services) into the Platform, but we disclaim all liability for their performance, security, or terms, which you accept by using them.4. Independence of Clinics and Financial Arrangements4.1. Clinics are wholly independent, autonomous entities operating under their own legal frameworks, professional ethics, and business policies. No relationship of agency, partnership, joint venture, employment, franchising, vicarious liability, or control exists between Body Abroad and any Clinic. We exert no influence over Clinic personnel, facilities, protocols, pricing, or decisions.4.2. Body Abroad may receive compensation from Clinics, such as referral commissions (typically 10%-25% of invoiced fees), marketing fees, or fixed payments, disclosed herein for transparency. To our knowledge, these do not increase your costs, but you are advised to conduct independent price comparisons. Such arrangements do not imply endorsement or bias in referrals.4.3. All monetary transactions for Clinic services, including deposits, fees, extras, or refunds, must occur directly between you and the Clinic per their terms. Body Abroad does not process, hold, escrow, or intermediate such funds and disclaims all fiduciary duties.4.4. Any administrative fees charged by Body Abroad for facilitation (e.g., coordination charges) shall be transparently quoted upfront, invoiced separately, and non-refundable except in our sole discretion, net of any deductions for costs incurred.4.5. You bear exclusive responsibility for all financial implications, including currency fluctuations, bank fees, exchange rates, taxes (e.g., VAT, withholding), duties, or penalties. Body Abroad shall not reimburse or adjust for such matters.4.6. In cases of Clinic bankruptcy, closure, non-performance, fraud, or disputes, Body Abroad disclaims all liability for your prepayments, losses, or Claims; insurance is your sole safeguard.4.7. You warrant that all payments are from legitimate sources and comply with anti-money laundering laws; any suspicions may lead to Service termination and reporting.5. Logos, Standards, Accreditations, and References5.1. The Platform may display or reference international standards, organizations, logos, or badges (e.g., JCI, ISO, Temos, GHA, WHO, or aesthetic-specific bodies like ISAPS) for informational, comparative, or illustrative purposes only, to highlight potential benchmarks some Clinics may claim to meet.5.2. Body Abroad neither holds, claims, implies, nor represents any certification, accreditation, endorsement, affiliation, partnership, or validation by such entities. The mere display of logos confers no rights, obligations, representations, or liabilities on us.5.3. Not all referred Clinics possess or maintain these accreditations; verification of credentials, licenses, board certifications, insurance, or regulatory compliance is your exclusive duty. Body Abroad performs no audits or guarantees ongoing validity.5.4. Any User reliance on such references shall not form grounds for Claims against Body Abroad. We disclaim all liability for inaccuracies, expirations, revocations, or misrepresentations in Clinic-reported credentials.5.5. In beauty and transplant contexts, references to standards are non-endorsing and generic; no implication of quality or safety is intended.6. Information, Content, Accuracy, and Comprehensive Disclaimers6.1. All Content provided by Body Abroad—via the Platform, emails, materials, or otherwise—is furnished strictly on an “as-is,” “as-available,” and “with all faults” basis, solely for general, non-reliant informational purposes, without any warranties, representations, or guarantees of any kind, express, implied, statutory, or otherwise.6.2. Data sources, including but not limited to pricing estimates, procedure overviews, success metrics (e.g., 92% satisfaction, 350K+ clients supported), Clinic profiles, testimonials, or images, originate from Clinics, public domains, or aggregated reports. Body Abroad does not independently audit, validate, update, or corroborate such information and thus provides no assurances of its veracity, currency, completeness, accuracy, or relevance to your circumstances.6.3. Errors of any nature—typographical, factual, computational, omission-based, or otherwise—may occur despite reasonable care. Body Abroad reserves the unqualified right to correct, amend, delete, or withdraw Content at any time, without notice, liability, or obligation to archive or notify.6.4. Numerical, statistical, or projective representations are historical snapshots from external data and must not be construed as predictive, binding, personalized, or assured. Refunds are discretionary and net of all expenses.7.5. You are liable for all transactional ancillary costs, including fees, taxes, duties, or penalties. Body Abroad reserves the right to assume defense of any claim, with Client cooperation required.14. Termination and Suspension14.1. These Terms remain effective until terminated. Body Abroad may suspend or terminate Services immediately for breach, non-payment, or legal compliance reasons, without notice.14.2.
